Terms of Service - Pocket Recorder

These Terms of Service ("Terms") govern your use of the "Pocket Recorder" mobile application ("the App"), provided by NoFutureApps ("we," "our," or "us"). By downloading, installing, or using the App, you agree to be bound by these Terms.
1. Description of Service
Pocket Recorder is an audio recording application. The App lets you record audio in the background, choose recording presets and formats, play, rename, share and delete recordings, and (with PRO) edit recordings and use additional formats and presets. We may add, change, or remove features over time.
2. Eligibility
The App is not intended for children under 13, and you may not use it if you are under 13. By using the App, you represent that you are at least 13 years old and able to enter into these Terms.
3. Lawful Recording
You are solely responsible for how you use the App. Laws in many countries require the consent of some or all participants before a conversation, call, lecture or performance is recorded. You agree to comply with all laws that apply to you, to obtain any consent required, and to respect the privacy and intellectual property rights of others. You agree not to use the App for any unlawful, covert or unauthorized recording.
4. Acceptable Use
You agree not to:
- use the App for any unlawful or unauthorized purpose;
- infringe the intellectual property, privacy or other rights of others;
- copy, modify, distribute, reverse-engineer, or create derivative works from the App except as permitted by law;
- interfere with or disrupt the normal operation of the App.
5. Pocket Recorder PRO and Payments
5.1 Free and paid features
Recording without time limits and the core features are available free of charge. Additional features are available through a one-time purchase, Pocket Recorder PRO. The current list of PRO features is shown in the App before purchase.
5.2 One-time purchase
PRO is a one-time purchase, not a subscription: there are no recurring charges. The price is shown in the App and on Google Play before you confirm the purchase. We may offer temporary discounts; the discounted price and its end time are shown in the App.
5.3 Billing and restoring
Purchases are sold and billed through Google Play and verified with the help of RevenueCat. Your purchase is linked to the Google account used on Google Play. If you reinstall the App or use it on another device with the same Google account, you can restore PRO with "Restore purchase". We do not receive or store your payment card details.
5.4 Refunds
Refunds are handled by Google Play under its applicable terms. If a purchase is refunded, PRO features are removed.
6. Your Recordings and Intellectual Property
6.1 Your recordings
We do not claim any ownership of your recordings. They are stored on your device, and we do not have access to them.
6.2 Our content
The App, including its design, code, and features, belongs to NoFutureApps and is protected by intellectual property laws. Open-source components included in the App are provided under their own licenses, listed in the App under About us → Open-source licenses.
7. Backups and Data Responsibility
Your recordings are stored only on your device. You are responsible for keeping your own copies of important recordings. We are not liable for any loss of recordings, including loss caused by device failure, deletion, storage problems, interruptions of the recording or operating system restrictions.
8. Privacy
Your use of the App is also governed by our Privacy Policy, which is incorporated into these Terms by reference and is available at https://nofutureapps.tech/pocket-recorder-privacy-policy.
9. Disclaimers
The App is provided "as is" and "as available," without warranties of any kind, whether express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, and non-infringement, to the maximum extent permitted by law. Recording quality and available formats depend on your device's hardware and software.
10. Limitation of Liability
To the maximum extent permitted by applicable law, we shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of data, recordings, profits, or use, arising out of or related to your use of (or inability to use) the App. This includes, without limitation, any interruptions caused by force majeure events, war, military operations, national emergencies, or disruptions in power supply or telecommunication networks. Nothing in these Terms excludes or limits liability that cannot be excluded or limited under applicable law.
11. Termination
You may stop using the App at any time and delete it from your device. We may suspend access to PRO features if a purchase is refunded, charged back or obtained fraudulently.
12. Changes to These Terms
We may update these Terms from time to time. We will update the "Last updated" date above, and material changes will be announced through the App or by other reasonable means. Your continued use of the App after changes take effect constitutes acceptance of the updated Terms.
13. Consumer Rights
Nothing in these Terms limits or excludes any mandatory rights you have as a consumer under the laws of your country of residence. Where such laws conflict with these Terms, those laws prevail. If you reside in the European Union, you have specific statutory rights regarding withdrawal from digital purchases, which are facilitated in accordance with Google Play's refund policies.
14. Governing Law and Disputes
These Terms are governed by the laws of Ukraine, without regard to its conflict-of-law rules. Subject to Section 13, any disputes arising from these Terms or your use of the App shall be subject to the jurisdiction of the competent courts of Ukraine.
